The sole document that contains legally binding information on the public offering of the Fund’s investment certificates is the prospectus prepared in connection with the public offering and the admission to trading of investment certificates issued by the Fund on the regulated market run by the Warsaw Stock Exchange. The prospectus has been approved through the decision of the Polish Financial Supervision Authority no. DSP-DSPZE.410.28.2023 of 31 October 2023 and – as a matter of principle – it is valid during the period of 12 months from that date. Please read the prospectus carefully, with the detailed description of all the necessary matters in relation to the Fund as well as the terms and conditions of investing in investment certificates. The prospectus also contains a catalogue of risks that may occur in connection with your potential investment. It should be pointed out that the Fund does not guarantee the achievement of a specific investment performance, the value of the assets of the Fund may be characterized by high variability and Participants should take into account the possibility of losing at least part of the funds invested in the investment certificates.
The public offering of the investment certificates takes places in the territory of the Republic of Poland exclusively. The prospectus and the investment certificates have not been nor are they the object of registration, application or notification in any other country. In particular, the investment certificates issued by the Fund cannot be offered or sold in the United States of America, Canada, Australia and Japan.
It should be particularly emphasized that in connection with the Council Regulation (EU) 2022/328 of 25 February 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (article 5f) and the Council Regulation (EU) 2022/398 of 9 March 2022 amending Regulation (EC) No 765/2006 concerning restrictive measures in view of the situation in Belarus and the involvement of Belarus in the Russian aggression against Ukraine (article 1y), the Public Offering is not addressed to Russian or Belarussian nationals or natural persons residing in Russia or in Belarus, or any legal persons or other organizational units with their seat in Russia or in Belarus. The prohibition referred to above shall not apply to nationals of a Member State or natural persons having a temporary or permanent residence permit in a Member State. Before subscribing for the investment certificates of the Fund, each investor should analyse on their own whether such sanctions apply to them, making the subscription and the acquisition of financial instruments impossible, and in case of doubts, seek legal advice with a professional entity.

Risk factors
The Fund has a high-risk investment policy. It should be understood that the final result of the Fund’s operation is not known and may bring to the Participants both the chance of achieving the assumed effect and the threat that the achieved effect may be significantly poorer than the original expectations. Due to the degree of a potential risk the Fund is dedicated to a group of investors with a high-risk tolerance, allowing for the possibility of losing a part or all of the financial resources invested in the Fund.
Risk factors related directly to the Fund’s investment policy: stock market risk, COVID-19 risk, commodity market risk, interest rate risk, exchange rate risk, credit risk, financial leverage risk, risk related to short sale transactions, settlement risk, liquidity risk, asset storage and registration risk, asset or market concentration risk, risk of investing in participation units (fund shares), investment certificates and participation titles, risk related to the conclusion of contracts for derivative instruments, risk related to legal or tax changes of the issuers.
Risk factors resulting from the specificity of the certificate: risk of failing to issue the certificates, risk of certificates’ liquidity, risk of not being able to trading in certificates as a result of not being admitted to stock exchange trading, suspension or exclusion of certificates from trading, risk of failure to issue the offered certificates until effect, the risk of rescheduling / canceling the issue by the Fund.

The occurrence of one, several or all of the hazards described in the points above may result in a lower rate of return on investment in certificates in relation to the expected one, and in extreme cases even a loss on investment in the certificates (reduction of certificate value below the initial investment value). Prior to the purchase of the certificates one should become familiar with all the risks and, based on their own assessment, decide on the rightness of their decision.
